Maguire v SOCOG
In a comprehensive victory, Bruce Maguire has succeeded in
demonstrating that SOCOG has discriminated against him on the basis of
his visual impairment. Human Rights and Equal Opportunity Commissioner
Carter QC accepted the evidence of Mr Maguire?s experts, Ms Jutta
Treviranus, Manager of the Adaptive Technology Resource Centre at the
University of Toronto, and Mr Tom Worthington, a computer consultant
and former Webmaster of the Department of Defence and ordered SOCOG to
make their website fully accessible to Mr Maguire and others with
similar disabilities. Commissioner Carter rejected SOCOG?s assertion
that accessibility "was and is too difficult, too onerous, too time
consuming, too risky and too expensive" and ordered them to make their
website fully accessible by 15 September 2000.
At a press conference yesterday (Monday 28 August), Mr Maguire thanked
his barrister, Sarah Pritchard, PIAC and his experts in finally
achieving justice. He said he hoped that SOCOG would now act to ensure
that their website is accessible. If SOCOG do not make the required
changes Mr Maguire can return to the Commission for a possible award
of damages. Mr Maguire said that what was important to him was
accessibility to the website illustrating one of Australia?s most
significant events. However it may be that if SOCOG refuse to follow
HREOC?s orders, other visually impaired people who use the internet
may wish to join him as part of a class action for damages against
SOCOG.
